1. Terms
1.1. Nela Gems – SIA Krafters, registration number LV45403050714.
1.2. Online store – the online marketplace www.nelagems.com, which the customer uses to place orders.
1.3. Program – a loyalty program that Nela Gems offers to its customers.
1.4. Terms and Conditions – this document. The Terms and Conditions set out the rights, obligations and other terms and conditions relating to the Programme.
1.5. Participant – a customer who participates in the Program in accordance with the Terms and Conditions of the loyalty program.
1.6. Profile – a virtual registration that ensures participation in the Program and the use of the benefits and services provided by the Program.
1.7. Program Website – Nela Gems website dedicated to the Program and located at the following web address: https://nelagems.com/pages/nela-gems-lojalitates-programma
1.8. Customer profile – the Participant's personal account on the website.
1.9. Privacy Policy – information on the processing of the Participant's personal data. The Privacy Policy is available on the website.
2. General provisions
2.1. These Terms and Conditions constitute an agreement between Nela Gems and the Participant regarding personalized offers, including personalized recommendations, and other benefits and services that Nela Gems is obligated to provide to the Participant and the Participant is entitled to receive in accordance with these Terms and Conditions.
2.2. These Terms and Conditions constitute a contract that is separate from any other transactions that may be entered into between Nela Gems and the Participant, including, but not limited to, where the Participant purchases goods from Nela Gems.
2.3. These Terms and Conditions set out the main rights and obligations of the parties, and other relevant provisions. By commencing participation in the Program, the client enters into an agreement with Nela Gems with the following Terms and Conditions. Before commencing participation in the Program, the client is introduced to the Terms and Conditions, and before becoming a Member, he has a free choice to agree or not to agree to them.
2.4. Nela Gems has the right to change the terms and conditions of these Terms and Conditions or to terminate the Program in whole or in part. Nela Gems will notify each Participant of the changes or termination of the Program by means of notices on the Program website and/or in stores and/or by e-mail and will ask the Participant to familiarize himself/herself with the changes.
2.5. By starting participation in the program, the Participant confirms that he/she has read the Privacy Policy. The Participant's data will be processed to ensure compliance with these Terms and Conditions.
3. Program benefits
Nela Gems provides the Program Member with the following benefits:
3.1. Nela Gems money
a) What is it? Nela Gems money is a discount that the Participant accumulates in their profile when making purchases, if the Participant has specified their profile at the time of a specific purchase, identifying themselves with the seller at the time of payment or making a purchase in an online store.
b) How can a Participant accumulate money? By spending 1 euro, a Participant gets 5 cents.
Participant will not receive Nela Gems money if he/she has not identified a registered profile at the time of purchase.
The participant does not receive Nela Gems money when paying using gift cards, or by purchasing third-party services (e.g. delivery with Omniva or by mail).
The Participant can receive information about the amount of savings in his/her profile.
c) How can a Participant use Nela Gems money?
The Member may use Nela Gems money to pay for purchases in Nela Gems stores, including the online store. Nela Gems money may be used to cover the purchase value corresponding to the amount of Nela Gems money in the Member's profile, subject to the restrictions set forth below.
To use Nela Gems money, the Participant must inform the store salesperson before making the payment, or indicate the coupon code in the online store.
Nela Gems money is valid for 1 (one) year from the date it is received in the Profile. The money received first will be the one that will be used when the customer wants to cover the purchase value.
3.2. Birthday offers
a) Rule
On the Participant's birthday, Nela Gems money is awarded.
3.3. Special games and lotteries
From time to time, Nela Gems organizes various games and lotteries for its Members. Information about current games and lotteries is available on the Nela Gems website.
3.4. Program usage overview
In their profile, the Participant can see information about the use of the program.
3.5. Other benefits
The Member may use other Program benefits that are available from time to time. Information about additional benefits is available on the Program website.
4. Participation in the program
4.1. Registration
Persons who are at least 14 years of age can participate in the program.
To begin participating in the Program, the participant must first register in the online store in order to use all the benefits specified in these Terms and Conditions.
By registering for the Program, the Participant creates his/her profile by filling in all required fields on the registration page.
The participant will be informed of successful registration with a special notification at the end of the registration process.
All related information regarding the processing of the Participant's personal data during the Card registration process and within the framework of Program participation can be read in the Privacy Policy.
Only after successful registration in accordance with the process explained above will the Participant be able to fully benefit from all the benefits of the Program as set out in these Terms and Conditions.
5. Rights and obligations of the parties
In addition to the rights and obligations of the parties set forth in other sections of these Terms and Conditions, the Parties shall also have the following rights and obligations:
5.1. Nela Gems:
5.1.1. will ensure the operation of the Program in accordance with these Terms and Conditions,
5.1.2. provide the Participant with benefits in accordance with these Terms and Conditions,
5.1.3. has the right to unilaterally change the Terms and Conditions,
5.1.4. will comply with all applicable laws and regulations in performing its tasks as set out in these Terms and Conditions,
5.1.5. has the right to exclude a Participant from the Program if the Participant violates these Terms and Conditions.
5.2. Participant:
5.2.1. will provide only correct and accurate data, and will immediately update the information if it changes or any inaccuracies are detected,
5.2.2. will not allow other persons to use their profile,
5.2.3. when using any and all channels, facilities and rights offered by these Terms and Conditions, you will comply with the requirements of the law and will not violate the rights of other individuals and legal entities,
5.2.4. will always act with integrity,
5.2.5. will not abuse any of the benefits offered within the Program.
6. Final conditions
These Terms and Conditions shall be governed by and construed in accordance with the laws of the country from which the services are provided to the Participant.
All disputes related to these Terms and Conditions or the Program will be resolved through negotiations. If no agreement is reached, then disputes will be considered in court in accordance with the procedure established by national law.
If a court or other competent authority finds any provision of these Terms and Conditions to be wholly or partially invalid or unenforceable, the remaining sections of these Terms and Conditions shall remain in full force and effect.
